Motion for leave to amend would add Thomson Vineyards and Okell Hill Vineyards as plaintiffs in pending constitutional challenge
September 17, 2026 (Napa, CA) — Attorneys for plaintiffs in Hoopes Vineyard LLC, et al. v. County of Napa, Case No. 3:24-cv-06256-CRB, pending in the United States District Court for the Northern District of California, have filed a motion seeking leave to add Thomson Vineyards and Okell Hill Vineyards as additional plaintiffs in the case.
The lawsuit, originally filed in 2024 by Hoopes Vineyard LLC, Summit Lake Vineyards & Winery LLC, and Cook’s Flat Associates (doing business as Smith-Madrone Vineyards & Winery), challenges the constitutionality of certain Napa County ordinances, policies, and enforcement practices governing wineries in the county. The operative complaint raises claims under the First Amendment, the Due Process and Equal Protection Clauses of the Fourteenth Amendment, the Takings Clause of the Fifth Amendment, the Dormant Commerce Clause, and California state law.
If granted, the motion would add Thomson Vineyards and Okell Hill Vineyards, both of which are pursuing winery development and permitting in Napa County, as plaintiffs asserting claims arising from their own interactions with the County’s land-use and code-enforcement processes related to their existing vineyards and well as their future winery operations.
The motion remains pending before the Court, which has set a hearing for November 20, 2026. Napa County has not yet had the opportunity to respond to the motion or to any of the allegations it would add.
